Two of the most important ideas in the philosophy of law are the “Coase Theorem” and the “Prisoner’s Dilemma.” In this paper, the authors explore the relation between these two influential models through a creative thought-experiment. Specifically, the paper presents a pure Coasean version of the Prisoner’s Dilemma, one in which property rights are well-defined and transactions costs are zero (i.e. the prisoners are allowed to openly communicate and bargain with each other), in order to test the truth value of (...) the Coase Theorem. In addition, the paper explores what effect (a) uncertainty, (b) exponential discounting, (c) and elasticity have on the behavior of the prisoners in the Coasean version of the dilemma. Lastly, the paper considers the role of the prosecutor (and third-parties generally) in the Prisoner’s Dilemma and closes with some parting thoughts about the complexity of the dilemma. The authors then conclude by identifying the conditions under which the Prisoner’s Dilemma refutes the Coase Theorem. (shrink)

Nick Bostrom, pionero del transhumanismo como movimiento filosófico, estipula dos supuestos dentro de su proyecto de mejora humana: (1) que es un proyecto de carácter liberal (i.e., que no coacciona seres humanos) y (2) que es un proyecto neutral (i.e., libre de intereses -políticos, económicos e ideológicos-). En este escrito mostraré que (1) y (2) son falsos. En ese sentido, plantearé que el transhumanismo es, en sus ideales, un proyecto de eugenesia o mejoramiento humano “liberal”. Sin embargo, en su realización (...) y en algunos de sus argumentos, se transforma en un proyecto de eugenesia o mejoramiento “totalitario”. Esto es así porque el proyecto transhumanista contiene un elemento de la eugenesia totalitaria: la coacción. Para poner esto en evidencia planteo tres argumentos y expongo un caso de mejoramiento humano que avalan los transhumanistas desde el enfoque de la biología sintética: la modificación genética prenatal. Este caso es importante porque permite mostrar cómo un agente externo toma decisiones (coacciona) sobre otro. Por tal motivo, se propone la creación de un comité bioético que tenga como objetivo principal analizar los argumentos y motivaciones de los padres para modificar a su(s) hijo(s) en etapa embrionaria dando espacio a un ejercicio de democracia deliberativa entre diferentes actores de la sociedad. -/- . Marta Suria writes *Ella soy yo* as part of her response to the irruption of the memories of the sexual aggressions she had suffered since childhood. She is convinced that the way she narrates her experience will transform and liberate her. How is it at all possible that a certain kind of narrative may transform and li- berate us? In this paper, we will first describe the conception of the relationship between language and experience that lies behind this perplexity and, (...) secondly, we will sketch an alternative conception that will hopefully allow us to account for the transformative power of certain kinds of narratives. This alternative conception will hinge on the idea of expression and on the concept of aspect perception. For this purpose, we will firstly argue that language can be used not only to describe or evaluate our experience, but also to express it; we will, then, defend the view that linguistic or gestural expressions of our experiences not only announce or manifest them, but contribute to shaping and modulating them; finally, we will highlight the transformative, humanizing power of certain expressive uses of language. This study determined the cognitive skills achievement in mathematics of elementary pre-service teachers as a basis for improving problem-solving and critical thinking which was analyzed using Piaget's seven logical operations namely: classification, seriation, logical multiplication, compensation, ratio and proportional thinking, probability thinking, and correlational thinking. This study utilized an adopted Test on Logical Operations (TLO) and descriptive research design to describe the cognitive skills achievement and to determine the affecting factors. Overall, elementary pre-service teachers performed with sufficient understanding in dealing (...) with the TLO. However, in each logical operation, students were found to have insufficient understanding of probability thinking and correlational thinking. These insufficiencies in other logical operations were attributed to their misconceptions on some mathematical terms, misinterpretation of the problems, poor comprehension skills, poor problem-solving skills, and poor performance in mathematics in general. Feminism has long grappled with its own demarcation problem—exactly what is it to be a woman?—and the rise of trans-inclusive feminism has made this problem more urgent. I will first consider Sally Haslanger’s “social and hierarchical” account of woman, resulting from “Ameliorative Inquiry”: she balances ordinary use of the term against the instrumental value of novel definitions in advancing the cause of feminism. Then, I will turn to Katharine Jenkins’ charge that Haslanger’s view suffers from an “Inclusion Problem”: it fails (...) to class many trans women as women. Jenkins offers a novel norm-relevancy account of woman to avoid the Inclusion Problem. Unfortunately, Jenkins’ account has serious internal problems, i.e. problems by Jenkins’ own lights: it is unintelligible, or it suffers from an Inclusion Problem of its own. After that, I will develop novel arguments for the conclusion that the project of Ameliorative Inquiry is both incoherent and also impossible to complete—at least, impossible to complete in a trans-inclusive way. Trans-inclusive feminism, therefore, would do well to move beyond Ameliorative Inquiry. Insofar as that’s not possible, trans-inclusive feminism inherits the incoherence of Ameliorative Inquiry. Do the facts of evolution generate an epistemic challenge to moral realism? Some think so, and many “evolutionary debunking arguments” have been discussed in the recent literature. But they are all murky right where it counts most: exactly which epistemic principle is meant to take us from evolutionary considerations to the skeptical conclusion? Here, I will identify several distinct species of evolutionary debunking argument in the literature, each one of which relies on a distinct epistemic principle. Drawing on recent work (...) in epistemology, I will show that most of these initially plausible principles are false, spoiling the arguments that rely on them. And we will see that each argument threatens only one popular view of moral psychology: a “Representationalist” view on which our moral judgments rely crucially on a mental intermediary—e.g. a sentiment, gut reaction, or affect-laden intuition—delivered by our evolved moral faculty. In the end, only one evolutionary debunking argument remains a menace: an “ Argument from Symmetry ” that I will introduce to the literature. But we will see that it should worry only all naturalists, pressuring them into a trilemma: give up moral realism, accept a rationalism that is incongruous with naturalism, or give up naturalism. Philosophical discussions on cognition (ranging from computational and representational approaches to the 4E fra-mework), on the one hand, and those on sound and auditory per-ception, on the other, have hitherto remained apart. In this paper, the author addresses the concept of “auditory cognition”. While committing to the conceptual analysis of the latter, the author in-troduces the discussion of modality-specif ic approaches. Since the contributions made so far in the domain of the philosophy of sound and auditory perception are prone to (...) favor computational-repre-sentational approaches —e.g., the perceptual coherence model (Méndez-Martínez, 2022)—, the exploration of 4E possibilities will lay down a series of questions aimed to encourage future developers from that viewpoint. In that sense, the author explores conceptual entailments and connections between the genealogy of theories within the philosophy of sound and auditory perception, and the hypothesis of the extended cognition (EX). There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. This chapter describes the potential far‐reaching consequences of contemplative higher education for the fields of science and medicine.

In the standard thought experiments, dualism strikes many philosophers as true, including many non-dualists. This ‘striking’ generates prima facie justification: in the absence of defeaters, we ought to believe that things are as they seem to be, i.e. we ought to be dualists. In this paper, I examine several proposed undercutting defeaters for our dualist intuitions. I argue that each proposal fails, since each rests on a false assumption, or requires empirical evidence that it lacks, or overgenerates defeaters. By the (...) end, our prima facie justification for dualism remains undefeated. I close with one objection concerning the dialectical role of rebutting defeaters, and I argue that the prospects for a successful rebutting defeater for our dualist intuitions are dim. Since dualism emerges undefeated, we ought to believe it. (shrink)

We argue that prediction success maximization is a basic objective of cognition and cortex, that it is compatible with but distinct from prediction error minimization, that neither objective requires subtractive coding, that there is clear neurobiological evidence for the amplification of predicted signals, and that we are unconvinced by evidence proposed in support of subtractive coding. We outline recent discoveries showing that pyramidal cells on which our cognitive capabilities depend usually transmit information about input to their basal dendrites and amplify (...) that transmission when input to their distal apical dendrites provides a context that agrees with the feedforward basal input in that both are depolarizing, i.e., both are excitatory rather than inhibitory. Though these intracellular discoveries require a level of technical expertise that is beyond the current abilities of most neuroscience labs, they are not controversial and acclaimed as groundbreaking. We note that this cellular cooperative context-sensitivity greatly enhances the cognitive capabilities of the mammalian neocortex, and that much remains to be discovered concerning its evolution, development, and pathology. This work studies some problems connected to the role of negation in logic, treating the positive fragments of propositional calculus in order to deal with two main questions: the proof of the completeness theorems in systems lacking negation, and the puzzle raised by positive paradoxes like the well-known argument of Haskel Curry. We study the constructive com- pleteness method proposed by Leon Henkin for classical fragments endowed with implication, and advance some reasons explaining what makes difficult to extend this constructive (...) method to non-classical fragments equipped with weaker implications (that avoid Curry's objection). This is the case, for example, of Jan Lukasiewicz's n-valued logics and Wilhelm Ackermann's logic of restricted implication. Besides such problems, both Henkin's method and the triviality phenomenon enable us to propose a new positive tableau proof system which uses only positive meta-linguistic resources, and to mo- tivate a new discussion concerning the role of negation in logic proposing the concept of paratriviality. In this way, some relations between positive reasoning and infinity, the possibilities to obtain a ¯first-order positive logic as well as the philosophical connection between truth and meaning are dis- cussed from a conceptual point of view. The Philosopher and Writer Jean-Paul Sartre, in the dramatic work No Exit (1944), claims the inter-subjective relationship is full of conflict and that it is impossible to reach the dialogical ideal. We will confront Sartre´s conclusions from the proposal of the jewish philosopher Emmanuel Levinas in order to see his thesis about otherness. We will explain how, instead of some rational agreements that overcome the diversity inside totality, it is necessary to receive the other and respond to him in the transcendence that Infinity requires. The present paper was written as a contribution to ongoing methodological debates within the NCC project. We focus on the neural correlates of conscious perceptual episodes. Our claim is that the NCC notion, as applied to conscious perceptual episodes, needs to be reconceptualized. It mixes together the processing related to the perceived contents and the neural substrate of consciousness proper, i.e. mechanisms making the perceptual contents conscious. We thus propose that the perceptual NCC be divided into two constitutive subnotions. The (...) main theoretical idea that emerges as a consequence of this reconceptualization is that the neural correlate of a perceptual episode is formed in the neural interaction between content-processing and consciousness-conferring mechanisms. The paper elaborates this distinction, marshals some initial arguments in its favour, and tests it against some of the most debated theories of consciousness. (shrink)

[On the Ethics of Euthanasia Again: A Reply to Critics] The article is a reply to three critics of a previous piece on the ethics of euthanasia in which I defended physician-assisted suicide. According to Ingrid Strobachová it is necessary to give a greater attention to the significance of pain, which, she claims, may benefit from a phenomenological description. According to Marta Vlasáková my argument is not valid because two principles on which it is founded – i.e. the conception of (...) life as of fundamental value and the autonomy of the patient – are not in mutual harmony. Jakub Jirsa criticises the very concept of assisted suicide and the moral legitimacy and need for the legalisation of assisted suicide. To Dr Strobachová I reply that phenomenological description is as acceptable a method as any other – as long, that is, as it is not only a verbal game, but constitutes a real source of knowledge. To Dr. Vlasáková I argue that a more charitable reading of my argument is possible. The arguments of Dr. Jirsa against assisted suicide are beset with various inconsistencies, including the fact that he himself allows that doctors should tolerate suicide by the refusal of food and drink. Such an act does not, however, differ in any relevant way from doctor-assisted suicide. (shrink)

Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer a (...) primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

Concebir los derechos como una protección no-paternalista de los intereses de sus titulares supone aceptar que su aspecto más relevante consiste en la provisión de una competencia para renunciar o consentir su inobservancia por terceros, lo cual no tiene por qué coincidir con la mejor estimación de sus intereses, aun cuando estos últimos juegan un papel importante en la justificación de las posiciones jurídicas implicadas. A partir de la tesis de la correlatividad, los conceptos jurídicos fundamentales de W.N. Hohfeld y (...) una tesis de la combinación que armoniza los elementos de la voluntad e interés en la explicación de los derechos, en el presente artículo se tratará de mostrar por qué afirmar el carácter inalienable de los derechos contradice la función que estos desempeñan en los ordenamientos jurídicos modernos. // The understanding of rights as non-paternalistic protections of its holder’s concerns entails that the most important aspect of them is the provision of a power either to waive or to consent their encroachment by others, which does not necessarily coincide with the best appraisal of his/her interests, even when they play an important role in the justification of the subjective legal positions. From the correlativity thesis, the fundamental legal conceptions devised by W.N. Hohfeld and a combination thesis that merges the elements of will and interest in the explanation of rights, I will try to show why to stand up for the inalienable character of rights contradicts the function they perform in modern legal systems. Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. Estamos siendo testigos de grandes avances tecnológicos y, a la vez, de grandes desastres naturales y sociales que nos impulsan a plantearnos cuáles son las causas últimas de la degradación natural ecológica. El abuso en el uso de los recursos tal vez pueda tener relación con el abuso en el uso de la tecnología; incluso ser causa de la gran desigualdad social en el acceso a bienes necesarios para llevar una vida digna, raíz de muchos conflictos sociales. La ecología es (...) una disciplina científica, pero cada vez es más habitual ampararse en este término para lanzar opiniones o generar un debate de ideologías de índole catastrofista que no hacen más que generar malestar social sin visos de solución práctica. Las reflexiones sobre la ecología nos parece que deben plantearse de una forma interdisciplinar, pero no de cualquier manera, sino respetando el estatuto epistemológico de cada área del saber. Cuidar el método científico, en el ámbito científico; el filosófico, en el suyo propio; e incluso el teológico. El tema de nuestra relación con la naturaleza nos afecta tan íntimamente que casi todas las áreas del conocimiento pueden decir algo al respecto. En el presente trabajo comenzamos ese diálogo y presentamos las ideas básicas desde las que se podría plantear un modo de actuar humano respetuoso para con los demás hombres y los demás seres de la naturaleza, que mejore nuestro modo de vivir y evite más daños y perjuicios. A esto nos referimos cuando hablamos de “ética ambiental”. La ecología nos toca de cerca porque tiene que ver con el modo de habitar nuestro mundo y las relaciones que tenemos con los demás seres vivos y no vivos. A fin de poder delinear las líneas principales de una ética orientada al medioambiente es preciso, en primer lugar, conocer los datos científicos sobre el tema; en segundo lugar, analizar los problemas graves que se están detectando y comprender que muchas de sus causas todavía son desconocidas y precisan de un estudio más detenido; finalmente, es conveniente revisar las alternativas de solución que nos orienten a llevar una vida mejor, donde se sugieran modos de obrar que no nos cierren el camino hacia ese destino común que tenemos como seres humanos, y que integre al resto de criaturas porque no somos los únicos seres vivientes del planeta. La propuesta de una “ética ambiental” apunta a considerar un verdadero “ecologismo solidario”. (shrink)

Procurando aportar a la historia de las ideas en Santa Cruz, el ensayo reflexiona sobre dos pensadores. Así, por un lado, se toma en cuenta la obra y trascendencia de Manfredo Kempff Mercado, el filósofo cruceño más importante del siglo XX, un autor que, pese a morir hace casi 50 años y, además, tener una vida breve, continúa siendo citado por especialistas del pensamiento latinoamericano. Por otra parte, se considera el aporte intelectual de Sergio Antelo Gutiérrez, cuyos artículos y libros (...) fueron significativos para, comenzando esta centuria, discutir sobre la viabilidad del orden estatal. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) Tras analizar sucintamente las consecuencias científicas y filosóficas de la identidad mente-cerebro, se señalan argumentos a favor y en contra de mantener el debate mente-cerebro. En particular se consideran las nuevas técnicas de exploración del cerebro como argumento en contra de tal debate. Las deficiencias e insuficiencias de tales técnicas aconsejan mantener el debate mente-cerebro y no asumir el materialismo.

El éxodo de más de 5,6 millones de venezolanos representa un fenómeno migratorio con múltiples facetas, cada una merecedora de atento análisis y profundización. Ante la dimensión del movimiento de millones de seres humanos, se corre el riesgo de subestimar tragedias que ocurren dentro del drama migratorio. Una de ellas, es el exilio de científicos y académicos. Bajo esta perspectiva, la investigación tiene como objetivo general mostrar la banalización frente al riesgo de pérdida de talento y avance científico de países (...) en vías de desarrollo. Tomamos como objeto de estudio el caso de la Diáspora Científica Venezolana. Se abordan de forma multidisciplinar tres ejes temáticos: 1) Causas y consecuencias de la Ciencia en Riesgo, 2) Instrumentalización de la Ciencia en Riesgo y 3) Efectividad de programas dirigidos a científicos en riesgo. El primer eje temático, está fundamentado en analizar las causas y consecuencias de la Diáspora científica venezolana, centrándonos en los estudios realizados, desde el ámbito sociológico, de Iván de la Vega, Francisco Kerdel-Vegas y Tomás Páez. El segundo eje establece, desde el marco filosófico habermasiano-marcusiano, la conveniente preservación del statu quo de la Ciencia en riesgo, a través de instrumentalización y unidimensionalidad del quehacer científico en países en vías de desarrollo por parte de programas internacionales financiados por organismos privados y gubernamentales. El tercer y último enfoque tiene como punto de partida la situación actual de la diáspora científica y la exposición de soluciones eficaces que rompan la inercia presente, enmarcando las ideas dentro de la actual crisis de la posmodernidad. A filosofia da linguagem dedica-se ao estudo da linguagem natural. Não se dedica ao estudo de línguas particulares, tal como o português, o castelhano ou o inglês, mas sim ao estudo filosófico de características gerais da linguagem e da nossa capacidade e proficiência linguística enquanto seres humanos. A investigação do desenvolvimento da linguagem é uma tarefa a ser desenvolvida pela ciência – a paleontologia, a neurologia, etc. Mas a ciência ocupa-se de algo de que temos um conhecimento intuitivo prévio – (...) a linguagem natural. Ora, a filosofia da linguagem dedica-se em parte a tornar explícito o nosso conhecimento implícito da linguagem. Como tal, a filosofia da linguagem é uma disciplina central na filosofia. Este capítulo é uma introdução selectiva à filosofia da linguagem. A alternativa que se nos deparava era fazer uma breve apresentação de teorias do significado, da referência e da verdade, e ainda de alguns tópicos de pragmática, ou escolher um tópico em particular que é, tradicionalmente, o elegido nos cursos introdutórios à filosofia da linguagem. Este capítulo oferece assim uma introdução a alguns dos temas centrais e clássicos da filosofia da linguagem contemporânea. A maior parte do capítulo dedicar-se-á a teorias da referência, a de Frege e de Russell, e à sua crítica subsequente por filósofos como Saul Kripke. Isto poderia levar-nos a pensar que a filosofia da linguagem contemporânea continua, como era tradicional, focada simplificada da relação entre linguagem, mente e mundo. Nada podia estar mais longe da verdade, como se tornará claro. A grande alteração na perspectiva sobre o estudo da linguagem, que se deve a pessoas como Frege ou Russell, é que graças ao seu trabalho os filósofos passaram a reflectir sobre a contribuição semântica sistematicamente feita por diferentes categorias sintácticas nas diferentes construções frásicas em que possam ocorrer, por exemplo a de termos referenciais como os nomes próprios. A relação linguagem-mente-mundo continua a ser uma preocupação dos filósofos contemporâneos, mas de uma forma muito mais sofisticada, rigorosa e sistemática. Os filósofos preocupam-se agora, por exemplo, com as condições de verdade correctas de usos particulares de frases, com os estados de coisas reais ou possíveis que confeririam verdade ou falsidade às frases usadas, e com o valor cognitivo de distintos tipos de frases. Como indicaremos na última secção do capítulo, outros desenvolvimentos da filosofia da linguagem contemporânea dizem respeito àquilo que nós, enquanto seres humanos, conseguimos fazer por meio da linguagem, aos diferentes actos de fala possíveis, e aos diferentes níveis de significado que podemos comunicar por meio do uso de frases com um significado convencionalmente estabelecido. Os nomes próprios são termos singulares que intuitivamente indicam os objectos do discurso ou pensamento. Alguns nomes falham na sua função de referir, sem que, aparentemente, deixem de desempenhar um papel representacional. Isso é paradoxal: Por um lado, os objectos referidos deveriam fazer parte de uma caracterização correcta dos nomes próprios. Por outro lado, o significado das frases que incorporam nomes vácuos sugere que tais objectos são extrínsecos aos pensamentos transmitidos. Isto é o problema que se levanta com a existência (...) de representações vácuas. Este artigo apresentará o problema pela perspectiva dada pelo estado da arte corrente. (shrink)

This paper examines the relation between Pythagorean and Heraclitean political views. I argue that for Pythagoras, Heraclitus, and Archytas the cosmological and musical notions of harmony (ἁρμονία) and the related notion of concord (ὁμόνοια) have an intrinsic political significance. These thinkers variously reflect upon political harmony and concord, and agree that a crucial condition for it is law (νόμος), which according to Pythagoras and Heraclitus has a divine origin. I begin with the Heraclitean fragments 22 B51, 54, 72, and 114 (...) DK, in which social and political reflection is connected with the theory of the harmony of opposites. In the case of Pythagoras and early Pythagoreanism, the intense, albeit indirect political influence in Magna Graecia—as transmitted by Iamblichus and Porphyry—offers evidence for social and political ideas determined by a reflection on the cosmological role of harmony and number. Finally, Archytas’ political application of rational calculation in fragment 47 B3 DK, which aims at producing concord by establishing the just measures of wealth in the city, together with the testimony on Archytas’ intense and fruitful political activity, can be taken as confirmation that the thinker’s wider cosmological views were indeed intertwined with his political reflection and action. This paper provides a pragmatic framework for the analysis of argumentation and written interaction in computer-mediated communication (e.g. in forums or blogs). Grice's maxims are supplemented with a theory of linguistic politeness derived from Leech, which is in turn subordinated to a strategic theory of interaction and finally to a theory of aims and action, as defined in ideology and philosophy. Netiquette, politeness, strategy and wisdom are therefore structurally subordinated to each other in the overall theory of human action which (...) includes computer-mediated communication. (shrink)

How can both influence and be influenced by the action? Can they are modeled? The models can contribute to (...) your understanding? Information and knowledge can consolidate or destroy friendships? What are the most efficient means to produce, store, organize and retrieve knowledge and information? Such questions permeate the content of this book, bringing together Brazilian and foreign authors, seeking to contribute to the improvement of the understanding of each of the concepts involved and the relationships between them. This paper deals with those dimensions of narrative which define it as such (i.e. narrativity). It examines some current conceptions of narrativity, and puts forward an emergentist theory of narrativity, one which takes into account the narrative structuring effected by narratological analysis itself as a distinct cognitive activity.

El presente artículo analiza la técnica del fracking como una solución a la problemática que en materia hidrocarburos se había dado en las últimas dos décadas, y los impactos negativos que conlleva para la salud y el ambiente. Se plantea como solución la aplicación del principio de precaución que le permite al Estado actuar ante una situación de riesgo e incertidumbre. La metodología escogida fue de corte analítico-deductivo a partir de la normatividad vigente y de los postulados teóricos de algunos (...) autores que son referentes en la materia. Como resultados se presentan algunas reflexiones que invitan a considerar la aplicación de este principio, hasta tanto no se tengan estudios suficientes que garanticen que esta práctica preservará el ambiente y no afectará la salud humana. “Conciencia”, la sección inicial de la Fenomenología de Hegel, se ocupa de la comprensión del mundo físico que nos rodea. La sección siguiente, “Autoconciencia”, comienza a considerar nuestra comprensión de nosotros mismos y de los otros. Este orden de discusión no es ni arbitrario ni meramente conveniente. Por el contrario, una de las principales lecciones que hemos de aprender hacia el final del desarrollo de la “conciencia” es que nuestra mejor concepción del mundo que es el objeto de nuestras actividades (...) cognitivas es inteligible solo como una parte de un relato que además considera la naturaleza del sujeto que se dedica a tales actividades. La razón para esta transición expositiva es un aspecto importante en el idealismo de Hegel. En este capítulo ofrezco una reconstrucción racional de un argumento que veo como el soporte de esta transición y del tipo de idealismo que esta implica. (shrink)

In recent work, Williamson has defended a suggestive account of assertion. Williamson claims that the following norm or rule (the knowledge rule) is constitutive of assertion, and individuates it: (KR) One must ((assert p) only if one knows p) Williamson is not directly concerned with the semantics of assertion-markers, although he assumes that his view has implications for such an undertaking; he says: “in natural languages, the default use of declarative sentences is to make assertions” (op. cit., 258). In this (...) paper I will explore Williamson’s view from this perspective, i.e., in the light of issues regarding the semantics of assertion-markers. I will end up propounding a slightly different account, on which, rather than KR, what is constitutive and individuating of assertion is an audience-involving transmission of knowledge rule: (TKR) One must ((assert p) only if one’s audience comes thereby to be in a position to know p) I will argue that TKR, of which KR is an illocutionary consequence (but not the other way around), has all the virtues that Williamson claims for his account and no new defect. El acto lingüístico como acto de hablar, decir y conocer es una actividad que realiza el sujeto desde lo profundo de su conciencia. Consiste en la síntesis cognoscitiva que realiza el hablante de su intuición y de lo que añade mediante su imaginación y su razón, convirtiéndola en palabras de una lengua. El acto lingüístico y, por tanto, el lenguaje, es la proyección hacia las cosas de lo que el sujeto realiza en su interior. Las cosas así tienen un grado (...) de realidad relativo, el que el sujeto les da proyectando su intención significativa hacia lo que le rodea, utilizando para ello las palabras de una lengua, creando así su verdad o su logos. Mi intención en este artículo es reflexionar sobre la realidad humana del acto lingüístico en cuanto que es la respuesta del sujeto que vive una situación dada. (shrink)

Legal theorists seek to persuade other jurists of certain theories: Textualism or purposivism; formalism or realism; natural law theory or positivism; prison reform or abolition; universal or particular human rights? Despite voluminous literature about these debates, tremendous uncertainty remains about which views experts endorse. This Article presents the first-ever empirical study of American law professors about legal theory questions. A novel dataset of over six hundred law professors reveals expert consensus and dissensus about dozens of longstanding legal theory debates. -/- (...) Law professors also debate questions about the nature of the legal academy. Descriptively, which subjects (e.g. constitutional law) and methods (e.g. law & economics) are most central within the legal academy today? And prescriptively, should today’s legal academy prioritize additional areas (e.g. legislation) or methods (e.g. critical race theory)? There is great interest in these questions but no empirical dataset of experts’ views; this results in uncertainty about which views experts endorse. This Article’s empirical study also clarifies these questions, documenting law professors’ evaluation of over one-hundred areas of law. -/- The legal theory and legal academy findings support implications for legal scholarship, education, and practice. Clearly, debates about law and the legal academy’s evolution should not be settled by a survey. Nevertheless, insofar as law professors are experts about these issues, it is instructive to discover and carefully examine what views those experts hold, so as to help determine which views are most likely to be true and how the legal academy ought to develop. John Stuart Mill fue un reformador social. Como gran parte de los pensadores del siglo XIX, creía en la idea de progreso. Consideraba que se estaba viviendo un tiempo de transición, en el que se daba una tendencia hacia un mejor y más feliz estado de cosas, aunque también percibía que la época era de riegos y amenazas. No se pensaba ni como filósofo ni como académico ni como político, se veía a sí mismo como un reformador social, cuya función (...) era educar a la opinión ilustrada y progresista. El propósito de sus textos es persuadir y, con ello, ayudar a transformar. Sus tesis defienden la necesidad de organizar la sociedad moderna bajo ciertos principios para que pueda alcanzar un estado superior de progreso social y moral. -/- Contra la acusación de que John Stuart Mill es un pensador ecléctico, contradictorio y que no añade nada a los clásicos, el libro que el lector tiene en sus manos muestra que su originalidad no consistió en haber creado nuevos conceptos, sino en haber transformado conceptos fundamentales de la filosofía social, moral y política, matizándolos, otorgándoles nuevos sentidos y abriéndoles nuevas posibilidades. Fue un utilitarista, pero la doctrina utilitarista salió renovada de sus escritos. Fue un liberal, pero en un sentido nuevo de liberal, ni clásico ni contractualista. Fue demócrata, aunque en un sentido distinto del de la voluntad general de Rousseau. Fue socialista, pero un socialista cualificado. -/- Como educador de la opinión ilustrada, tuvo un éxito extraordinario. Sus libros tuvieron una gran acogida y su nombre gozó de prestigio, admiración y respeto en Inglaterra. The thesis that technology is applied science is called by Niiniluoto (1997) the standard view. That is surprising because the identification between technology and applied science has been widely rejected by both historians and philosophers of technology, including Rapp (1974), Bugliarello and Doner (1976), Derry and Williams (1977), Feibleman (1983), Skolimowski (1966), Vermaas et al., (2011), Don Idhe (2013). The reasons of such rejection mainly stem from the fact that technology has historically progressed without the benefit of science, i.e., it (...) has been possible to design technological devices without the explicit and systematic development of the scientific theories and laws that would explain their functioning. Polish philosopher Henryk Skolimowski has attacked this identification based on historical evidence. He argues that in the development of technology, there are many cases wherein technological designs have supported pure scientific research, rather than the other way round if technology were applied science. According to Skolimowski, some cases that dispute the identification of technology as applied science are the design of the transistor, supersonic aircraft, and the Manhattan Project. However, this historical evidence should not persuade us for two reasons: 1) Rejecting the previous scientific research that served as the basis for the said technological designs commits Skolimowski to anachronism. 2) From a realistic perspective of science, technological devices are not only subject to the principles and laws of science, regardless of the extent of our knowledge of them, but incorporate insights on more articulated explanations that while not available at the time of designing, do inspire our practical and theoretical efforts and guide further work. In this paper, we posit that the cases offered by Skolimowski to motivate his rejection of the standard view are far from being conclusive. To this end, we not only critically assess each case but also identify other historical examples that might be even more promising to support Skolimowski's thesis. Finally, we critically deal with those more promising cases and argue for a deflationary interpretation of the standard view. -/- . (shrink)

nos últimos anos, John McDowell tem proposto uma concepção de filosofia em que o objetivo da disciplina não é oferecer teses substanciais, mas antes revelar modos de pensar e premissas ocultas que estão na base da filosofia construtiva. Esta visão terapêutica tem sido chamada ‘quietismo’ e deve muito a algumas idéias favoritas de Wittgenstein ao longo de toda a sua vida. No entanto, a obra de Wittgenstein (e, talvez, também a de McDowell) parece oscilar entre duas compreensões de quietismo: pode-se (...) ser quietista por não macular aquilo que é mais importante com discussões explícitas ou pode-se ser quietista por não ter nada a dizer. Argumentaremos que o segundo tipo do quietismo não implica recusar em se ocupar com a filosofia do passado, nem tampouco adotar uma atitude contemplativa. A concentração sobre o particular, em ética tanto quanto em qualquer outra área da filosofia, é suficiente para minar as ambições universalistas da filosofia tradicional e descortinar um aumento na ação filosófica. El decir es anterior y va más allá del hablar, se vale del hablar y constituye la determinación del hablar. No hay un hablar sin un decir y sí puede haber un decir sin un hablar. El acto lingüístico es la manifestación del lenguaje, la lengua, el pensamiento y el conocimiento. Es fruto de un hablar, está determinado por un decir, presupone un conocer y revela la actitud del hablante, un sujeto libre e histórico, que es, a la vez, sujeto (...) hablante, dicente y cognoscente, ante la realidad y el mundo. De la misma manera que no se da un hablar sin un decir, tampoco se da un decir sin un conocer. En su génesis más profunda el conocer determina al decir y éste al hablar. Así, pues, el «ser hablante» (Coseriu) es, a la vez, el sujeto «dicente» (Ortega y Gasset) y el sujeto cognoscente (Coseriu, Ortega y Gasset, Heidegger, Aristóteles), porque se realiza a sí mismo en el acto del hablar y éste está determinado por el acto del decir y en última instancia por el acto del conocer. El decir define al hablante ante la realidad y el mundo y da soporte a lo que es la realidad y el mundo, que no es más que aquello a lo que el sujeto hablante, dicente y cognoscente le atribuye el ser o realidad. El ser humano, «coexistencia actuante de mí o yo con la circunstancia o mundo» (Ortega y Gasset), se libera de la necesidad vital en la que está inmerso, de la circunstancia a la que está inexorablemente ligado, mediante el conocer. Por el conocer el ser humano atribuye a eso que le rodea y afecta «el ser», haciendo de ello «cosas» y «mundo» constituido por «cosas». Todo esto se manifiesta en el acto lingüístico, que es un acto creador en un triple sentido: crea las cosas y el mundo (contenidos de conciencia, significados), crea la realidad de las cosas y el mundo, y crea la expresión de lo que es las cosas y el mundo (el lenguaje y la lengua) mediante lo dicho (lektón) determinado esto por el pensamiento (lógos). El acto lingüístico es creación (poiesis) y es manifestación (apóphansis), acto de crear un mundo y acto de desvelar el mundo interior del sujeto hablante, dicente y cognoscente, acto de desvelar lo que está oculto y que ahora es no-oculto o verdadero (a-lethés). El hablar, el decir y el conocer son acciones vitales del ser humano. El hablar es una acción vital del sujeto creador que le viene de fuera, de la comunidad; el decir es la acción vital que le viene de dentro y que proyecta él mismo hacia fuera, hacia la comunidad; y el conocer es el acto mismo de creación de un sujeto, que es, opuestamente, libre e histórico, absoluto y limitado, creador de formas y participante de formas comunes creadas en la comunidad. El hablar en sí mismo, al igual que la lengua, es a-circunstancial y tiene que ver con la creación en términos absolutos e históricos. El decir como manifestación del interior del sujeto hablante, dicente y cognoscente tiene que ver con la verdad o aquello que se manifiesta desvelándose (a-létheia). De esta manera, podemos ver dos clases de pensamiento o logos: el logos a-circunstancial o intersubjetivo o histórico, lógos semantikós, y el logos que manifiesta una realidad interior y crea una realidad exterior desde el interior del sujeto creador o lógos apophantikós. La lingüística del decir que ahora se presenta recoge una propuesta en el mismo sentido hecha por Ortega y Gasset y es la continuación de la lingüística del hablar de Coseriu. Hace un replanteamiento de la realidad radical, el ser hablante de Coseriu, que es concebido ahora como el sujeto hablante, dicente y cognoscente. Estudia el acto lingüístico, acto del hablar, decir y conocer, como la manifestación primera de la intención significativa de cada sujeto. Se basa en los principios de la lingüística del hablar de Coseriu, especialmente en los que describen el plano universal e individual del hablar, es decir, los principios de la confianza en el hablar del otro y de la congruencia y coherencia en el hablar. Mira, por consiguiente, al acto lingüístico como «producción», como aquello que se crea en el acto único del hablar, decir y conocer. La finalidad de la lingüística del decir es llegar la génesis misma del lenguaje, que no es más que la génesis del acto lingüístico. Analiza el acto lingüístico como la manifestación del acto del conocer, el cual partiendo de la aísthesis o intuición sensible (Ortega y Gasset, Heidegger, Aristóteles) o intuición inédita del hablante (Coseriu), se descompone en una serie de operaciones intelectivas, cada una de las cuales contribuye a configurar de una manera dada la «aprehensión del ser» inicial e inédita. Estas operaciones intelectivas son: la selección, el establecimiento de una designación, la creación de una clase o esencia, la relación, la nominación y la determinación. Tras la presentación y justificación de lo que es cada uno de los conceptos indicados arriba (los cuatro primeros capítulos), el libro dedica un capítulo a cada una de estas operaciones intelectivas, analizada e ilustrada con ejemplos. Como ilustración de lo que puede ser el análisis aquí propugnado, se dedica un capítulo al análisis del adjetivo 'brisk’, adjetivo de conducta de la lengua inglesa. (shrink)

Preface to the thematic volume Metatheoretical Structuralism: Some Recent Developments and Applications.

El consentimiento informado del paciente se inserta en el ámbito de su autonomía decisoria. Aunque presenta un sustrato corporal, este aparece combinado con elementos de índole moral que presuponen una noción concreta de persona como libre y autónoma. Tanto de las definiciones doctrinales como del material normativo se desprende que se trata de una posición jurídica subjetiva del paciente, alternativamente calificada como una “pretensión” o “derecho subjetivo en sentido estricto”, en términos hohfeldianos; un “derecho negativo de defensa”, o una “inmunidad”. En España, el Tribunal Constitucional ha vinculado el consentimiento informado del paciente al derecho fundamental a la integridad física y moral (15 CE), lo cual permite plantear el análisis en clave iusfundamental. Con todo, se advierten dudas e incompatibilidades entre la explicación habitual del consentimiento informado, su fundamento constitucional y su regulación jurídica. El objetivo del presente libro consiste en proporcionar una definición integral del consentimiento informado como derecho subjetivo del paciente y como manifestación de un derecho fundamental, a partir de una óptica poliédrica que aporta certeza en la práctica asistencial y jurídica. // The patient's right to informed consent is inserted within the scope of his decisional autonomy. Although it has a bodily background, it is combined with features of moral nature, which presupposes a concrete notion of the person as free and autonomous. Both, doctrinal approaches and normative legal material show that it is a subjective legal position of the patient, being alternatively qualified as a Hohfeldian “claim” or a “subjective right in a strict sense”; a "negative right" or an "immunity." The Spanish Constitutional Court has linked the informed consent of the patient to the fundamental right to physical and moral integrity (15 CE), which allows us to propose a fundamental rights-based analysis. Nonetheless, doubts and inconsistencies are perceived between the customary explanation of informed consent, its constitutional foundation and its legal regulation. The aim of this book is to provide a comprehensive definition of informed consent as subjective right of the patient and expression of a fundamental right, from a multi-fold perspective that provides certainty in both legal and health care practice.
